A solicitor with a minimum of over 10 year’s experience shall be carrying out the work in this area and dealing with your matter throughout.
We deal with all aspects of Wills and Trusts from simple Wills to complicated Trust set ups. We cover the following (but not limited to):-
We have a panel consisting of a professional mix of solicitors/lawyers, chartered accountants, chartered surveyors, financial advisors, tax advisors all the collective aspects you need to provide a complete overview, structured advice and strategic plan (including preparing all the documentation).
We would highly recommend that everyone make a Will (even a simple one), to utilise the latest legal advice and case law (and our panel of experts) so your wishes can be carried out and your estate dealt with in the most tax efficient way. If you have no Will then your assets will be distributed or divided up as per the intestacy rules, this is quite strict and not tax efficient.
We can advise you on the following and more:-
Will – We can draft simple or complex ones to make sure that those you care about get the benefit of your inheritance. Whether a simple Will, complex trust or multi asset probate matter we can assist you including succession planning. We take a pictorial view including estate administration, succession planning and tax implications. We can prepare single, mirror, trust, property trust, flexible life interest/living Will.
Estate Planning– we can review your assets to structure them to make sure you pay no additional tax and achieve your aim taking into account succession planning, wealth preservation and asset protection
Trust – we can set up trusts as part of your Will or separately to make sure your assets are protected and family/dear ones are covered. We can prepare all types of Trusts including bare, interest, possession, discretionary, accumulation, mixed, non-resident, charitable, irrevocable life insure
Powers of Attorney – we can prepare all types of powers including general, lasting, enduring and appoint attorneys (people you trust) to take care of you, manage your property and assets if you lose capacity. Lasting Powers of Attorney being property and affairs, health and welfare.
Probate – we can deal with administration of simple estates to detailed ones with multiple assets and liabilities.
We recommend utilising trusts, they are useful tools:-
-to pass on asset to the next generation (fund children and grandchildren’s education/deposit for home or investment)
-guard against care home fees
-provide for ex/partners, step children
-guard against divorce and children’s divorce (claims again their assets that you passed to them)
-provide support for vulnerable in old age/retirement (place to live, income)
We can make a bespoke plan for you to include discretionary trusts and take into account asset protection, wealth preservation, intergenerational wealth management, estate succession planning, so allowing Trustees to have greater powers (including management ones) to use for the benefit of the beneficiaries. We can also put assets into trust (land, property, shares/dividends, monies in accounts, policies, pensions, in order to generate Income (including rental) and for life insurance and future.
We offer fixed fees in some cases and hourly rates for more complicated time consuming matters. Having had a fact finding and detailed discussion regarding your personal situation, we shall advise you of the most professional and efficient way to progress your matter, taking into account your wishes and providing you with options if so required.
Each matter will be specific be spoke and thus we cannot quote an initial price at the outset until we have had an initial meeting, fact finding and assessed and advised you what your options are and then can notify you of costs.
